The Legal Proceedings Unit of the Direction générale de la cohésion sociale (DGCS) is responsible for processing appeals and following judicial procedures (administrative, criminal and civil) regarding social assistance, as well as providing the necessary legal support to the activities of our directorate. In order to strengthen this dynamic entity of about 20 employees, the DGCS is looking for a Legal Counsel.
Responsibilities ##
• Examine, investigate and rule on appeals filed against decisions taken by the application authorities (AA) of the Revenu d'insertion (RI), namely the Centres sociaux régionaux (CSR) and the Centre social d'intégration des réfugiés (CSIR) in matters of social assistance.
• Prepare and file criminal complaints regarding reported offenses in RI matters and follow the procedure.
• Manage the continuation of procedures and ensure the representation of the DGCS before the various administrative and criminal instances autonomously, including in the event of appeals or calls to the Tribunal cantonal or the Tribunal fédéral.
• Request the constitution of real estate pledges from RI beneficiaries who own property and conduct the procedure in direct collaboration with the notary.
• File maintenance actions on the basis of articles 277 para. 2 and 329 CC and represent the DGCS within the framework of civil procedure.
• Prepare legal opinions for the attention of the Application Authorities and the DGCS in specific files and participate in the development of the unit's collective knowledge.

Qualifications ##
