It was created by the Confederation following the ratification of the Optional Protocol to the UN Convention against Torture and other cruel, inhuman or degrading treatment or punishment (OPCAT) by the Federal Act of 20 March 2009 on the Commission for the Prevention of Torture (SR 150.1). The NKVF fulfills its tasks independently. The commission consists of twelve members who are elected for four years by the Federal Council. It has a permanent secretariat.
